Human Rights Campaign Reacts to the Supreme Court’s Decision Denying Certiorari for Transgender Student Bathroom Ban Case, Metropolitan School District of Martinsville v. A.C.

This decision reinforces numerous circuit and district court rulings, finding that existing federal protections prohibit school districts from discriminating against transgender students

WASHINGTON – Today, Human Rights Campaign (HRC) President Kelley Robinson reacted to the Supreme Court’s decision to deny certiorari for Metropolitan School District of Martinsville v. A.C., a case regarding the Indiana school district’s refusal to allow transgender students to use the restrooms that align with their gender identity. This decision leaves in place the 7th Circuit Court decision finding that policies that deny transgender students access to restrooms consistent with their gender identity violate Title IX of the Education Amendments of 1972 and the Equal Protection Clause of the 14th Amendment. In 2021, the Court denied a petition of certiorari for Grimm v. Gloucester County School Board, leaving in place a 4th Circuit ruling that also found that these bathroom bans violate protections set in Title IX of the Education Amendments of 1972 and the Equal Protection Clause of the 14th Amendment.

Human Rights Campaign President Kelley Robinson released the following statement:

“Every kid deserves to be treated with kindness and respect—full stop,” said Human Rights Campaign President Kelley Robinson. “This decision affirms the rights of transgender students, but we know that there is still so much work to be done. From book bans to “Don’t Say LGBTQ+” laws, LGBTQ+ youth—especially transgender and non-binary youth—are facing hate-fueled, targeted attacks designed to censor and erase them. We must continue to fight for LGBTQ+ students so that every child, no matter their race, religion, or gender identity, can live, learn, and thrive as their authentic selves.”
