Lambda Legal filed the federal lawsuit in the U.S. District Court for Arizona today on behalf of seven same-sex couples and the surviving spouses of two additional same-sex couples.
"If businesses in our state are going to attract top talent, Arizona has to keep our welcome mat out," said Sheila Kloefkorn, local business owner and a leader with the Human Rights Campaign. "Allowing same-sex couples to marry isn’t just the right thing to do -- it’s the smart thing to do."
Lambda Legal and Perkin Coie LLP argue in the suit that Arizona’s constitutional amendment and state statutes banning marriage equality violates the Equal Protection Clause and the Due Process Clause of the U.S. Constitution.
Yesterday’s case is the latest in a slew of lawsuits nationwide, where couples are fighting for the right to marry the person they love.
