Summary: These bills would exempt domestic partners from inheritance tax on a joint primary residence held in joint tenancy that passes from a deceased partner to a surviving partner for the surviving partner’s use.
Status: HB 1215 was introduced February 13, 2009 and hearings were held in the House Ways and Means Committee on March 19, 2009. On April 8, 2009, the bill passed the House of Delegates by a 99-35 vote. SB 785 passed the Senate Committee on Budget and Taxation on April 2, 2009. On April 10, 2009, the bill passed the Senate by a 27-18 vote. The bill now heads to Gov. O’Malley’s desk.
