Equal Benefits Ordinance: Long Beach, Calif.

Passed on November 17, 2009
Effective in January 2010 (estimated)

Applies to:

  • City public works, construction or improvements contracts and contracts for the purchase of goods or services over $100,000 (after the first year, the city staff can recommend a lower threshold).
  • New business leases of city property in which the city receives more than $350,000 in annual gross receipts.

Exceptions & Waivers

Does not apply to:

  • The Harbor Department, Airport, and Housing Corporation of Long Beach.
  • Leases of city property in which the city is the lessee.
  • Sub-tenants of city property.
  • A product or service that is "indispensable to the city or the public welfare and not available through a firm with equal benefits."
  • Non-profit companies.

Enforcement

This ordinance has yet to become law. Before it can become law, the City Attorney's office must write the language of the ordinance and then Council has to approve the language in two subsequent council meetings.
