Gender identity protected? No
No provision of Montana law explicitly addresses gender identity-based discrimination. The Montana Constitution addresses discrimination based on "race, color, sex, culture, social origin or condition, or political or religious ideas." Mont. Const., Art. II § 4 (2001).
Sexual orientation protected? No
Montana prohibits sexual orientation discrimination in public employment, however no provision of Montana law has been read to address sexual orientation discrimination in private employment. The Montana Constitution addresses discrimination based on "race, color, sex, culture, social origin or condition, or political or religious ideas." Mont. Const., Art. II § 4 (2001); Montana Nondiscrimination-EEO Rules, 2.21.4001 et seq., Dec. 22, 2000.
