Florida Sodomy Law

Florida’s sodomy law was struck down by the U.S. Supreme Court on June 26, 2003, as a result of the Court’s decision in Lawrence v. Texas, No. 02-102 (U.S. June 26, 2003). Florida did not have a specific sodomy law per se but relied upon an “unnatural and lascivious act” law, which qualifies as a second-degree misdemeanor. Fla. Stat. § 800.02 (2001). Not since Franklin v. Florida, 257 So.2d (Fla 1971), has the Florida “sodomy law” been enforced against homosexual conduct.
