Looking Ahead: Issues the Courts May DecideIn recent years, we have seen important legal victories in cases like Lawrence v. Texas (2003) and Goodridge v. Department of Public Health (2003). These milestones signal that independent judges are willing to enforce the constitutional rights of gay, lesbian, bisexual and transgender Americans, even if they face criticism for doing so. These countries recognize marriage equality for same-sex couples, as of the year stated: the Netherlands (2001), Belgium (2003), Canada (2005) (earlier in some provinces), Spain (2005), South Africa (scheduled for 2006). Contrary to what some may have predicted, the institution of marriage has not disintegrated in any of these countries! (It’s also still going strong in Massachusetts, where marriage equality was recognized in 2003). |
