Marriage for Same-Sex Couples: Considerations for Employers

The legal definition of "spouse" as used in many employment and benefits contexts has changed considerably since the establishment of marriage for same-sex couples in Massachusetts in 2004, followed by California, Connecticut and, most recently, Iowa and Vermont. Employers across the country must reassess their benefits with respect to same-sex spouses.

In June 2005, Nike Inc. announced its support for a civil unions bill just before a historic vote in the Oregon Senate. A bipartisan group worked to rewrite legislation prohibiting discrimination based on sexual orientation in housing, employment and public services.
