Today, lawyers for the plaintiffs in the Utah marriage equality case, Kitchen v. Herbert, filed a request urging Supreme Court Justice Sonia Sotomayor to allow same-sex marriages to continue while the Tenth Circuit Court of Appeals considers the state’s appeal.
The move is a direct response to Utah state officials, who on December 31 requested that the Supreme Court halt marriage equality until a decision is reached by the Tenth Circuit Court of Appeals.
Justice Sotomayor is responsible for handing motions, such as emergency requests, for the Tenth Circuit, and may at any time either rule independently, or refer consideration to the entire Court.
Though the court battle rages on, loving, committed same-sex couples continue to tie the knot in the Beehive State after U.S. District Judge Robert Shelby ruled on December 20 that the state’s ban on same-sex marriage was unconstitutional.
