Another Federal Court Finds DOMA Unconstitutional

Late today, a federal district judge in San Francisco ruled that the Defense of Marriage Act violates the U.S. Constitution. In a case brought by Lambda Legal on behalf of Karen Golinski, a federal employee denied health and other benefits for her same-sex spouse, George W. Bush appointee Judge Jeffrey White concluded that DOMA discriminates against same-sex couples “without substantial justification or rational basis.” A year and half ago, a federal judge in Massachusetts reached a similar conclusion in Gill v. OPM and Massachusetts v. HHS, two cases now before a federal appeals court in Boston.
