New DOMA Brief - DOJ Calls Law Discriminatory

Today the Justice Department filed a new brief in the Smelt case -- a challenge to the discriminatory federal Defense of Marriage Act (DOMA). After criticism of an earlier brief in the case (including HRC President Joe Solmonese's letter to the President) the Administration reiterated its opposition to the 1996 law in today's filing calling it discriminatory but argues it has the duty to defend the statute. Tomorrow, the Transportation Security Administration will implement Secure Flight, a program designed, according to TSA, to “streamline the [terrorist] watch list matching process” by requiring all passengers to provide their gender and date of birth when they book a ticket. Unfortunately, the potential impact on transgender travelers - whose identity documents often don't match their gender expression -was almost certainly not part of TSA’s considerations when the program was developed.
